One year ago my wife was taking our daughter to pre-school turning left out the end of our road in to traffic, this road has a speed limit of 35 mph. Traffic had to stop to let her cross the first lane since it was solid cars, vans and small trucks. As she approached half-way, before getting a good view of oncoming traffic, another car took off the front bumper. Note that the center line is interuppted at the cross-junction. The bumper was torn from the front of the car with damage more evident on the non-impact side of the car than where initially hit, hence my wife had not initiated a turn, just edging forward to see. The radiator was in-tact, but damaged, still mounted to the front of the car. I walked to the site with our other child and took my daughter home; she is fine and I took her to school but still talks of the incident today. My wife stayed at the incident, and was fine (no later issues) keeping real calm and cooperating with police. It took about 2 hrs with police debating which town the incident took place (middle of the road is the divide) and the other driver was concerned about getting home to take a pot off the stove, but seemed medically fine. The driver asked me and the police to drive them home to get the pot off the stove and used my wifes cell phone more than once. They also wanted to drive their car home and leave the scene with a flat tire at one point I presume to attend to the pot. No tickets were issued, no air bags deployed. The other car had a flat front left tire and side damage so the drivers door was stuck shut. Both cars were old, so written off. Over a year later we received a court summons from their attorney and we are being sued for $750,000. Our limit is $100,000 on insurance. The plaintiff is claiming herniated discs and loss of bowel control. We have a 2006 no money down mortgage, so total equity is very much in the red since our home value plummeted. I have no umbrella policy. I am sole income, but was owner of the car my wife was driving. My wife is stay-at-home mom. The remaining $650,000 would be a big problem. Interestingly, we heard that the other driver called our insurance and asked for a >100-fold lower amount of money to just go away! Our insurer recalls this very clearly and did not pay. Questions: Should I invest in an attorney to work with our insurers attorney to cover the $650K over our limit? Do we have any case given the car the other driver may have been in a rush (as all were aware of the pot on the stove), would have settled for far less, and in reported safety tests should avoid an obstacle at 55mph let alone at the speed limit of 35 mph? Their case, as I understand, is to actually prove my wife was negligent, she was just trying to see. Reality and the law are complicated I understand. Our insurer is looking in to the validity of their medical claims. I believe for spinal and neck injuries plaintiffs have to follow careful insurance approved treatment plans in NJ. I know that such a condition may not be permanent with curative surgery possible to release the nerves that may be causing the bowel issue. The plaintiff has claimed the injury as permanent, do they need to prove this? Should we ask experts? The plaintiff lives in our town and their house is on my running route every other day. I have not noted anything at all and plan to stay away from all other parties. Should I change my running route? Thanks for any advice. Our 30 day clock is ticking.

Background: My wife left me and is filing for divorce. She took her car which is a marital asset that both of us own. She has since left the state to move in with a friend and I cannot get a hold of her as she will not return my calls. Update: Our current auto coverage is set to expire on 10/17. I have taken out coverage on myself through a different company, set to start on the 17th. As of the 17th she will be uninsured unless she takes out her own policy. Is is my responsibility to make sure she is still insured on my policy? She won't return my calls or the calls that my new agent has left for her so my hands are tied. When Servpro cut draywalls ut shows that stabs 2x4 has been damaged , they spray them ( we think that they need to replace them )......... Farmers Insurance problem when changed from CA to OR?

Hi, I've had insurance in CA for 2 years and moved to Oregon recently. I had my insurance tranferred with an useless Farmers Agent in OR. The thing is I already paid my 6 months premium in CA which is covered me until 06/2009. I paid nearly $450 for until 06/29. I've had quite a few discounts in CA but the jug-head agent in Oregon, not shifted any discounts to Oregon automatically. I got a bill for next 6 months from that agent saying that I have to pay $1000, since I haven't lived in Oregon for long enough. Jeez!!!. It's almost a $600 rise in my insurance that too I haven't had any claims or ticket in my last 5 years. I went to meet him in person but he told that's all he can do it. I have a question regarding car insurance. I'm 29 years old. I've been in 3 car accidents but was not at fault for any of them (2 of the times my car was sitting still! lol) and I've never gotten a ticket for any of those accidents. I used to have insurance through State Farm, full coverage for a 2004 Jeep Liberty that cost 50-60 a month in upstate NY. While driving to NYC one winter I got a speeding ticket, my first ticket ever! I was going I think 82(?) in a 65. This was just before I moved to NYC, and because I got the ticket in a podunk little county I was driving through I had no idea what the name was, the ticket flew out my door and I lost it. I figured they would mail me something else to tell me the payment was late but I never received anything else about it. Well I found out later it was because I moved, even though I moved about 2 months after the fact they wait quite a while to send another notice, and I never received it. Thus, my license was suspended but I never knew. I never got caught driving without it either. So I moved here in 2007 with my Jeep which I was very behind payments for, and then it got towed away for alternate side parking BS. I could have borrowed the money back then to pay to get it out but I let it go. Alright so long story short, I don't have the truck, it was auctioned. I'll be done paying for it through a collection agency settlement offer this May. If I had kept the truck, I would be paying 200+ more a month than I pay now, and I wouldn't have been done paying it til August 2011. Plus I would have had to pay to catch it up the 3 months I was behind, plus pay my boyfriends brother back who was willing to lend me the money to get it out of the car jail (lol) I had the suspension lifted last July so I could rent a car, again no issues. So I'm thinking of buying a 2,000 car (cash! I learned my lesson) in June when I'm done paying for the truck and I want to get no fault insurance. I know it will be a lot more here then what I used to pay, and in addition I now have a suspension that wasn't there before. How much do you guys have to pay for your insurance, if it's not too much information to ask? And how much do you think mine might be, or compare your cost and history to mine? Thanks.

I was involved in a fender bender where no party admitted fault. Other persons insurance company went to arbitration against my insurance company to recover their loss. Arbitration Panel decided in our favor i.e. I am not at fault hence need not pay the damages. Total loss amount listed by other party was $800. My car did not have any damage worth repairing. (Also, I am lazy and passive enough to not pursue too hard for a minor dent.) After arbitration settlement other person filed a lawsuit against me in small claims court. I was pretty sure that a judge cant do anything after arbitration. To my surprise judge assessed that out of $800 - $250 was the deductible paid by other person. Prior Arbitration did not include that amount hence he can adjudicate on this $250. He adjudicated against me for $250 + legal fee. Judge also told me that I need not worry about this money as my insurance will pay for it. (Most ridiculous judge and judgment I have ever seen, but thats a separate matter) I called up my insurance company. They are willing to pay this amount. My question is will making them pay increase my insurance premium. I have a pretty clean record with no at-fault accidents. I pay about $1000 per year for two cars in WA state. They stated it could take up to 4 weeks for processing. I'm 16 and when I turn 17 I plan on trying to get my provisional and pass a CBT test. My mum has an old Honda c90 90cc motorbike which she doesn't use anymore and I could have. It only goes 40mph and struggles to maintain that. I was wondering how much insurance would be though, as it is one of the major turn offs. I only have an additional $1000 per year to pay for any additional costs, would this be enough to cover the extra insurance and maintenance costs of an old used Porsche Boxster, one that seems to need quite a lot of mechanical work done at a Porsche dealer, compared to my old and flawless Toyota Corolla? I drive a 2000 Toyota Corolla and over the years I change my own oils, my own fluids, and have only taken it in twice for tire alignments, that's it. The costs are extremely low. Now I see a 1998 Porsche Boxster for sale, with a slightly leaky engine and a Balking automatic transmission for sale. I would like to have fun and buy it, but I cannot afford any more than about $1000 per year in maintenance costs.
